Jonathan Owen, Solicitor at the Dental Law Partnership helped our client, Mrs V, obtain £2,800 after her dentist failed to treat decay.

Dental decay

Mrs V, from the South East was a regular attendee with her dentist Dr Y for a number of years. She expected to be provided with the best level of care during her visits and hoped that Dr Y would pick up on any problems if they occurred with her oral health.

Dr Y provided Mrs V with a filling, after which Mrs V started to experience pain from the tooth. She then went back to the dentist numerous times in pain but nothing seemed to be done. Eventually as the pain was continuing, Mrs V decided to get a second opinion.

It was at her appointment with another dentist that Mrs V was advised that she would need root canal treatment and a crown at the tooth that had been causing her pain. It was asserted for the client that If Dr Y had treated the decay correctly then the pain and the root canal treatment would have been avoided.

Mrs Y said, “A while after I was given the filling it became painful to eat on that side of my mouth, I couldn’t sleep at all either. I went back so many times and mentioned the pain but was just sent on my way. It shouldn’t have been necessary for me to go somewhere else to get the decay at the tooth treated, which will now require root canal treatment! I feel really let down by my dentist and this whole situation that could have been avoided.”
