West Midlands woman awarded £10,000 after dentist failed to diagnose and treat decay
Georgina France, solicitor at the Dental Law Partnership, acted on behalf of a client who was awarded £10,000 after her dentist failed to diagnose and treat decay, failed to properly treat an infection and provided poor restorative treatment over a 10 year period.
Ms L, from the West Midlands, was a regular attendee with her dentist Dr D and believed he would be providing her with the best level of care.
During one visit Ms L mentioned that she had been suffering with toothache, the tooth had had ongoing problems over many years. Dr D provided her with a course of antibiotics and suggested if the pain didn’t subside she should return. Unfortunately the pain didn’t go away and Ms L was told that she required root canal treatment at the tooth that was causing her problems. Thinking this was the best option Ms L agreed and the root canal treatment took place.
Not long after the procedure Ms L was still experiencing pain so decided to see another dentist to get their opinion. It was at this appointment when the extent of the negligence was spotted. Dr D had failed to treat Ms L’s decay when carrying out root canal treatment. Due to decay still being present the tooth had to be extracted.
Georgina commented, “The dentists’ poor level of care has meant that our client has endured avoidable episodes of food trapping, sensitivity, pain, infection and toothache emanating from the problem area for almost 10 years.
She also underwent avoidable root canal treatment, and then an avoidable extraction. Not only has she suffered all this she will now need an implant fitted and replacement implant retained crowns at regular intervals for the foreseeable future.”
Ms L compensation amount will go towards restorative treatment and will hopefully help her move on from her ordeal.
